The customer agrees to be bound by and accepts these terms and conditions. These terms and conditions apply unless the customer has signed a separate formal purchase agreement with the xmod ltd, in which case the separate agreement shall govern; or unless other standard terms apply to the transaction. These terms and conditions are subject to change without prior written notice at any time.
This agreement and any sales there under shall be governed by Scottish law.
Description of good and services
The xmod Ltd is a business to business reseller. In buying from The xmod Ltd you acknowledge and agree that you are buying goods or services for business purposes. As a business customer, purchases you make from us will not benefit from the same statutory protection available to consumers under the Sale of Goods Act 1979 (as amended) and related legislation.
Please note that you are buying a mix of MoD / Commercial Surplus and some new eqipment, it is not all new and is sold 'as is'. It does not have any tractability or certification from the manufacturer. All goods are only suitable for reference unless tested before use. At the bottom of each product listing is the stock suppy type.
Viewing can be arranged for any items before you purchase goods. Some items may require to be tested when used in certain environments, you the "Customer" are responsible for testing anything you buy and making sure they comply to any regulation or tests that they require to comply with currant safety regulations.

Orders; Quotes; Invoices. Terms of payment are within The xmod Ltd sole discretion, and unless otherwise agreed to by The xmod Ltd, payment must be received by The xmod Ltd, prior to The xmod Ltd acceptance of an order. Payment for the products can be made by transfer, cheque or some other prearranged payment method unless credit terms have been agreed to by The xmod Ltd. Invoices are due and payable within the time period noted on the invoice, measured from the date of the invoice. The xmod Ltd may invoice parts of an order separately. Orders are not binding upon until accepted by The xmod Ltd. Any quotations given by The xmod Ltd will be valid for the period stated on the quotation. Customer agrees to pay interest on all past-due sums at the highest rate allowed by law.
Delivery charges and Taxes
Charges will be shown on The xmod Ltd, invoice(s). The customer is responsible for any sales or any other taxes associated with the order, however designated.
Dispatch
Your order will be sent on the service chosen (Standard /ECO). We aim to have all orders sent with 48 working hours.
If any loss or damage occurs during shipping by a carrier selected by The xmod Ltd will be The xmod Ltd responsibility. Loss or damage that occurs during shipping by a carrier selected by the Customer will be the Customer's responsibility. Any damaged items must be reported with 48 hours from delivery date.
If any item is missing or damaged and reported within 48 of delivery : We will issue a refund as we may not be able to replace it.
Warranties, Disclaimers.
The xmod Ltd disclaims all warranties, express or implied, including without limitation implied warranties of' merchantability and fitness for a particular purpose. In addition to these Terms and Conditions, customer agrees to be bound by the acceptance of contract terms contained elsewhere in this site. The xmod ltd can not be held responsible for any loss relating to products supplied, including loss of profits, loss of business or any other consequential, special, indirect or punitive damages even if advised of the possibility of such damages, or for any claim by any third party.
Information listed on the xmod ltd trading site (www.thetoolbook.co.uk) is for information only, any part numbers or information can not be guaranteed as accurate and is for guidance/reference only. Images of products may be a representation of what you will get. We can not guarantee that the item in the images will be the same as you will receive.
Storage Charges
We charge £35 plus VAT per day for each item. Goods must be collected within 7 working days from the order date.
Returning of Goods;
Returns will not be accepted without a returns number (RMA). You can do so provided you inform us of your decision within 2 working days (48 Hours) of receipt of goods and at your own expense. They must be retuned to us within 7 days of the RMA date. Once the item is received, we'll issue a refund to your original payment method. Please note this policy has some limitations. We may charged a restocking fee upto 20%. We will aim to get your payment refunded within 7 days from the date of return being accepted back.

Free Eco delivery on orders under 20Kg placed on the advertized day only. (British GMT Time)
Some highlands and islands postcode areas may be subject to review or additional charge. (We will try our best).
This is only available to mainland UK customers. Orders must be created / placed online.
Credit account holders are not entitled to any free postage as the order must be paid at the time or order.

Bidder : Any person or company placing a bid
All transactions to which these conditions apply and all matters connected with them shall also be governed by Scottish law.
By placing a bid you the Bidder are confirming that you are over 18 and capable of entering into a contract with the Auctioneer.
All goods are sold untested and 'AS IS' we do not accept any returns for auction items.
The Auctioneer may at their absolute discretion, lower any reserve price, divide any lot, combine any lots, withdraw any lots, refuse bids, regulate bids and cancel any sale at any time without reason or notice.
The Bidder will pay for items within 3 working day of the auction ending. Payment methods listed on the auction listing will be the only ones accepted as payment. Any cheque payments require 6 business day to clear before any goods can be released.
The Buyer shall pay the Final Price plus any VAT on the Final Price. Any requests to refund VAT should be made in writing to the Auctioneer and shall be assessed on the individual basis.
The Contract between the Bidder and the Auctioneer will only be formed when we confirm our acceptance of you bid, whether or not the Auction Site states that your Bid is the current Highest bid.
Goods must be removed within 7 days of the auction ending.
We will endeavour to pack and despatch any purchases as quickly as possible via the Royal Mail or approved carrier, the insurance risk of carriage is borne entirely by the purchaser.
The xmod Ltd policy is one of on-going, product updates and revisions. The xmod Ltd may revise and discontinue products at any time.
